Modus Furniture is committed to socially responsible business practices, ensuring our products are not mined, produced, or manufactured, wholly or in part, with child labor or prohibited forms of labor, as defined by 19 U.S.C. § 1307 and the International Labor Organization’s Convention No. 29.
Facility Disclosure & Approval
All facilities producing merchandise for Modus Furniture require our prior disclosure and approval. Each approved facility must also maintain a comprehensive list of all entities, including subcontractors and home workers, who provide materials or services for our merchandise.
Documentation & Verification
Suppliers must maintain all necessary documentation to verify compliance with this policy and all applicable laws and regulations, making it available upon request. This requirement also applies to any third-party employment agencies used by the facility. Documentation includes, but isn't limited to, licenses, permits, certifications, policies and procedures, and employee and facility records.
Child Labor
This policy specifically prohibits the use or permission of child labor in any facility within our supply chain. A "child" is defined as a person who is younger than the highest of the following ages:
- The age for completing compulsory education in the country where the work is performed;
- The minimum age for employment as defined by applicable national or local law; or
- Fifteen (15) years old (or fourteen (14) where the law of that country permits in accordance with International Labor Organization (ILO) exceptions for developing countries).
Modus Furniture supports legitimate workplace apprenticeship programs. Vendors must comply with all applicable laws and regulations governing such programs and any legal restrictions placed on authorized minors. These may include limitations on overtime hours, hazardous work, night work, and requirements for medical fitness certificates or annual medical check-ups.
Forced and Indentured Labor
Vendors and their business partners must not use forced labor in any form, including prison labor, indentured labor, bonded labor, or otherwise.
"Forced Labor" is defined as any work or service extracted from a person under threat of penalty for non-performance, and for which the worker does not offer themselves voluntarily. Mental and physical coercion, slavery, and human trafficking are strictly prohibited across the entire supply chain. This includes transporting, harboring, recruiting, transferring, or receiving vulnerable persons by means of threat, force, coercion, abduction, or fraud for exploitation.
Workers must never be required to surrender any government-issued identification, passports, or work permits as a condition of employment. Additionally, labor conditions must be provided to workers in writing, in a language they understand.
Audits
Modus Furniture reserves the right to audit, or authorize a third party to audit, any facility involved in the production, processing, or harvesting of our merchandise. These audits may include any subcontractors used by the facility. Audits will be unrestricted and may occur with or without advance notice.
Consequences of Violations
Violations of this policy may result in immediate sanctions, including, but not limited to, partial or full cancellation of purchase orders or contracts, and restrictions on future business. Should a business relationship be terminated due to a violation, Modus Furniture may consider reinstatement only after a satisfactory audit and the implementation of an approved plan for sustainable improvement.
